Property Acquisition Risk Checklist for Türkiye

Property Acquisition Risk Checklist for Türkiye

A property risk review should happen before a deposit becomes non-refundable. Verify the buyer's eligibility, current title, seller authority, liens and annotations, project status, location restrictions, price and payment route. Separate ownership rules from residence-registration restrictions: an address can be commercially attractive yet unsuitable for a specific migration plan.

Distinguish two kinds of area control

Property law restricts some acquisitions by nationality, military or security areas, national land totals and district ratios. Migration authorities separately publish neighbourhood restrictions for new registrations. They solve different questions.

Make the contract reflect the checks

Define what happens if title, authority, valuation, financing, citizenship eligibility or transfer conditions fail. A checklist is useful only when the payment and exit clauses follow it.

Documents and preparation

  • Current title record
  • Seller identity and authority
  • Municipal and project records relevant to the property
  • Buyer eligibility confirmation
  • Written price, currency, recipient and refund terms
  • Valuation or TTB records where applicable
  • Current address-status check for the intended residence plan

Risks and checkpoints

  • Relying only on a sales brochure
  • Treating appraisal as a title check
  • Paying an unrelated account
  • Confusing property eligibility with residence registration
  • Ignoring the power-of-attorney scope
  • No written refund trigger

Official sources and verification date

Use our property acquisition guidance and relocation coordination to keep the two reviews aligned. The full sequence is in the step-by-step buying guide.

Frequently asked questions

Are closed neighbourhoods a ban on ownership?

Not necessarily. The official migration notice concerns new registrations and residence changes; ownership eligibility is a separate property-law review.

What are the general official area limits?

TKGM states up to 30 hectares nationwide and up to 10% of privately owned district area, subject to other restrictions.

Does an appraisal prove clean title?

No. Value evidence and title ownership or encumbrance checks answer different questions.

When should the checklist be completed?

Before a non-refundable deposit or payment and again before the registry transfer.
